Acceptance of Terms
These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "your") and Stringbet Software, LLC ("Stringbet," "we," "us," or "our") governing your access to and use of the website at wolfbitegolf.com (the "Website") and the Wolfbite mobile applications for iPhone, Apple Watch and Android (the "App"). The Website and the App are referred to together as the "Services."
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
Eligibility
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you meet this requirement.
Description of the Services
Wolfbite is a scorekeeping application for golf games played for stakes agreed among friends, such as Wolf, Flip and Nassau. The App records the scores, the bets the group agrees to and the settings the group chooses, calculates the resulting payouts, lets other members of the group follow a round, and keeps a history of rounds. The Website describes the App and hosts these Terms and the Privacy Policy.
We may modify, update or discontinue any part of the Services at any time, in our sole discretion.
Scoring and Wagers
Wolfbite does not take, hold, transfer or pay out money. It is a calculator and record of what the members of your group have agreed among themselves. Any wager recorded in the App is a private arrangement between the players; Stringbet is not a party to it and has no obligation to collect, enforce or settle it.
You are responsible for deciding whether to play for stakes and for complying with the laws that apply where you play. Do not use the Services where playing for stakes among friends is unlawful.
The App's calculations follow the rules you configure. You are responsible for checking the settings and the scores entered. Stringbet is not liable for a payout figure that results from a setting, a score or a rule chosen by you or another player.
The App may offer a link that opens a third-party payment application with an amount filled in. That application is not part of the Services, and any payment made through it is governed by its own terms.
Accounts
The App requires you to sign in with an Apple or Google account. You are responsible for the security of that account and for all activity under your Wolfbite account. You agree that the name shown to other players is accurate enough for them to recognize you. We may suspend or terminate accounts at any time in our sole discretion, and you may delete your account at any time as described at wolfbitegolf.com/delete-account.
Subscriptions
Some features of the App require a paid subscription, offered as an annual plan through the Apple App Store or Google Play. The price and any free trial are shown before you subscribe. The subscription renews automatically at the end of each period unless you cancel it through the store at least 24 hours before the period ends. Subscriptions are managed, billed and refunded by the store under the store's terms; Stringbet cannot change or refund a subscription directly. Deleting your Wolfbite account does not cancel a subscription.
Use of the Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in any manner that could disable, overburden, damage or impair them, or interfere with another party's use of them
- Attempt to gain unauthorized access to any part of the Services, other accounts, or the computer systems or networks connected to them
- Use automated means to access the Services without our prior written consent
- Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by applicable law
- Reproduce, distribute, publicly display or create derivative works based on the Services or any content in them without our prior written authorization
- Remove, alter or obscure any proprietary notice, label or mark on or in the Services
- Enter the names of people in a way intended to harass, impersonate or defame them
Suspension and Termination
We may suspend, restrict or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or your use may cause harm, legal risk or disruption to the Services or others. We may take reasonable technical and legal steps to prevent unauthorized or abusive use.
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, governing law and dispute terms) survive any termination.
Intellectual Property
All content, features, functionality, software, code, designs, text, graphics, logos and other materials available through the Services ("Content") are owned by Stringbet or its licensors and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property laws.
These Terms do not grant you any right, title or interest in the Services or any Content, except the limited right to use the Services in accordance with these Terms.
User Content
The Services let you enter content such as player names, course names and course details ("User Content"). You retain ownership of your User Content. By submitting it, you grant Stringbet a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, modify (for formatting or display), distribute, display and otherwise use it solely to operate, improve and provide the Services and related communications. A course you add or correct may be kept in the shared course catalog for other users after your account is deleted, without any link to you.
You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any law, infringe any third-party right or breach these Terms. We may remove or restrict User Content at any time for any reason. We do not guarantee that we review or monitor User Content.
App Store Terms
The App is distributed through the Apple App Store and Google Play and is also subject to the terms and policies of those platforms. Apple and Google are not parties to these Terms and have no obligation to furnish maintenance or support for the App.
Feedback
If you submit suggestions, ideas or feedback about the Services ("Feedback"), you agree that we may use it without restriction or obligation to you, and you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, distribute and otherwise exploit the Feedback for any purpose.
Third-Party Links and Services
The Services may contain links to third-party websites, services or resources that we do not own or control. We do not endorse and are not responsible for the content, privacy practices or terms of any third party. Your use of third-party websites and services is at your own risk.
Electronic Communications
By using the Services or contacting us electronically, you consent to receive communications from us electronically, by email or by notices posted on the Website or in the App. You agree that all agreements, notices, disclosures and other communications we provide electronically satisfy any legal requirement that they be in writing.
Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Stringbet disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
Without limiting the foregoing, Stringbet does not warrant that the Services will be uninterrupted, error-free, secure or free of viruses or other harmful components, that any defect will be corrected, or that any calculation produced by the App is correct.
Your use of the Services is at your sole risk.
Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Stringbet, its officers, directors, members, employees, agents or licensors be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, use, goodwill or other intangible losses, or any amount wagered or owed between players, arising out of or related to your access to, use of, or inability to access or use the Services, whether based on warranty, contract, tort (including negligence), statute or any other legal theory, even if Stringbet has been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, the total aggregate liability of Stringbet for all claims arising out of or related to these Terms or the Services shall not exceed the greater of (a) the amount you paid to Stringbet, if any, for the Services during the twelve (12) months preceding the claim, or (b) fifty United States dollars ($50.00).
Indemnification
You agree to indemnify, defend and hold harmless Stringbet and its officers, directors, members, employees and agents from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your User Content; (d) any wager or dispute between you and other players; or (e) your violation of any right of any third party.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in the State of Mississippi, and you consent to the personal jurisdiction of those courts.
Assignment
You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization or sale of assets.
Severability and Waiver
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision is severable and does not affect the validity and enforceability of the remaining provisions. Our failure to enforce any right or provision of these Terms is not a waiver of it. A waiver is effective only if in writing and signed by Stringbet.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Stringbet with respect to the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.
Changes to These Terms
We may modify these Terms at any time. Changes are posted on this page with an updated "Last updated" date. Your continued use of the Services after revised Terms are posted means you accept them. It is your responsibility to review these Terms periodically.
